RealStat

Terms of Service

The public offer in English.

Version 2026-10-11. Доманська Дарина Юріївна, individual entrepreneur (ФОП) registered in Ukraine, tax number 3772111103, Україна, 09108, Київська обл., Білоцерківський р-н, місто Біла Церква, ("we", "us").

No separate contract is signed. These Terms are a public offer. You accept them in full by creating an account, together with the confirmations in section 3. Subsequent payments are taken automatically on a subscription basis and require no further signature. The DPA forms part of these Terms.

One set of terms for everyone. These Terms apply identically to customers inside and outside the European Union. We do not maintain separate editions per jurisdiction: the level of data protection described in our Privacy Policy and DPA meets GDPR requirements and is applied to every customer regardless of where they are. This English text is a translation of the Ukrainian public offer (legal/ua/oferta.md); in case of conflict, the Ukrainian text prevails.

1. The service

RealStat is a hosted software service that:

Provided as software-as-a-service, "as is". No source code is transferred and nothing is installed on your equipment.

2. Plans and payment

Plans are published at real-stat.net. Billing is in advance, monthly, via WayForPay.

Refunds. One rule for every customer, whether a business or an individual, and wherever you are.

Within 14 calendar days of the payment date we refund on request, no reason needed. Write to vtargetolog@gmail.com from the account that paid; we refund to the original payment method within the timeframe set by the payment provider. We do not ask for a reason and do not assess one: inside that window any reason is sufficient.

After those 14 days a payment is not refundable — including where you cancel mid-period: access then continues to the end of the paid period, but the unused remainder is not credited back.

In particular, after the 14 days we do not refund on the basis of:

That list applies to the period after the 14 days. Inside the 14 days it does not apply — the first paragraph governs.

One exception: if the service is unavailable through our fault for more than 24 consecutive hours, section 5 applies and we extend your billing period by the downtime.

On equal treatment. We do not run a separate consumer regime: the 14 days with no reason needed apply to everyone. Where a mandatory rule of consumer protection law gives an individual customer a right broader than this section provides, that rule applies; the rest of these Terms stands in full.

3. Your responsibilities

Not boilerplate — without these the service either does not work or does not work lawfully.

  1. Provide access. Add our bot as an administrator of your channel with the right to invite users; supply your pixel ID and Conversions API token.
  2. Have a legal basis — personally. You warrant and confirm that: - you have a lawful basis for processing your subscribers' personal data and for transferring it to advertising platforms (Meta, TikTok); - you maintain your own privacy notice, available to your subscribers, which states plainly that subscription data is transferred to advertising platforms and names RealStat as the service involved; - where consent is required, you have collected it in a form that meets applicable law.

You give these warranties by a separate action at sign-up — not by accepting these Terms generally, but by a distinct confirmation. We record the date, time and IP address of that confirmation and keep it for the life of the account plus three years; you may request a copy. The warranties are repeated each time you connect a new channel or bot. 3. Accept the platforms' terms. Meta Business Tools Terms, TikTok Business Products Terms and Telegram's Terms of Service are between you and them, accepted when you obtain access. 4. Do not upload data you have no right to. 5. Do not introduce special category data — health, religion, political opinion and the like — through campaign names, creative names or message content. 6. You are responsible for what you send. Welcome and broadcast copy, offers, links, media and sending frequency are entirely your decision and your responsibility. We provide the tool and do not moderate content.

3.1. We are not responsible for what you do

We provide a technical tool. Every decision about how to use it is yours, and responsibility for those decisions is yours.

We are not liable for:

Indemnity. If a claim, action, supervisory-authority complaint or penalty is brought against us and it arises from your acts or omissions listed above, or from a breach of the warranties in section 3(2), you will indemnify us for the resulting loss, including reasonable legal costs and any fine imposed. We will notify you of such a claim without delay and will not admit it without your agreement.

This provision governs the relationship between us and you. It does not, and cannot, limit the rights of data subjects or the powers of supervisory authorities — see section 1.5 of the DPA.

3.2. Our tracking domains

So that attribution works, we provide you with a technical domain from our pool — the address your ads point at and from which a person reaches Telegram. The domain is not transferred to you: it belongs to us, is registered and paid for by us, and is given to you for use while your account is active. You may connect your own domain instead at any time.

What follows from that:

  1. We do not review or moderate the ads, landing pages, offers or channels the issued domain leads to. A domain is an address, not an endorsement of what sits behind it.
  2. The traffic is your responsibility. Everything in section 3.1 applies in full to traffic passed through a domain we provided: the lawfulness of the advertising, the content of the offer, compliance with the rules of the ad platforms and of Telegram, and the rights of third parties.
  3. You must not run traffic through a provided domain that involves: fraud or deception; phishing, malware, or imitation login or payment pages; sexual material involving minors or any sexualisation of them; trafficking in people, weapons or controlled substances; unlawful financial schemes, including pyramids and "investment" offers made without the required authorisations; counterfeit goods or infringement of intellectual property; or incitement to hatred or violence. The list is not exhaustive: anything that breaks applicable law or the rules of the platforms carrying the traffic is prohibited.
  4. We may withdraw a domain — immediately and without notice — on a substantiated complaint or a demand from a registrar, hosting provider, ad platform or competent authority, or if we find a breach of point 3 ourselves. We will offer you another domain from the pool; if the breach continues, section 7 (Termination) applies.
  5. We do not guarantee the reputation, continuous availability or unblocked status of a provided domain in any external system. A domain may be flagged by an ad platform, a messenger, an antivirus or an ISP for reasons outside our control, including the actions of other users of the pool or your own. We will replace such a domain from the pool within a reasonable time; we carry no other obligation connected with a domain's reputation, and a drop in advertising performance arising from it is not a ground for a refund or credit.
  6. A domain is not a hosting or communications service. We do not host your sites, provide mailboxes on these domains, or delegate DNS control to you.

When the agreement ends the domain returns to our pool and links on it stop working. Move active campaigns to your own domain in advance — see section 7.

4. What we do not promise

Stated plainly, so nothing here creates an expectation the technology cannot meet:

  1. Cheaper advertising is not guaranteed. We give the platform a cleaner signal. The result depends on your creative, offer, audience and budget.
  2. A 100% match rate is not guaranteed. If someone opens Telegram on a different device or browser, some clicks stay unpaired. Your actual match rate is shown in the dashboard — we do not hide it or round it up.
  3. We are not responsible for Telegram, Meta or TikTok. API changes, a banned channel, a disabled ad account or a restricted bot are outside our control. We will adapt to API changes within a reasonable time.
  4. We cannot see your existing subscribers. The Telegram Bot API does not expose them, and workarounds break Telegram's rules and risk your channel. We work only with people who join after connection.
  5. We cannot show message reads. The Bot API has no read receipts. We report delivery, and we do not describe delivery as a view.

5. Availability

We aim for uninterrupted service but do not guarantee it. Planned maintenance is announced 24 hours ahead. If the service is unavailable through our fault for more than 24 consecutive hours, we extend your billing period by the downtime.

6. Liability

Our aggregate liability is limited to the amount you actually paid in the preceding three months. We are not liable for lost profit, wasted advertising spend or indirect loss.

This limit does not apply to wilful misconduct, gross negligence, or breach of our data protection obligations.

7. Termination

You may terminate at any time from the dashboard. We may terminate on 30 days' notice, or immediately if you use the service for spam, to circumvent platform rules, or for unlawful activity.

After termination your data is retained for 90 days so you can export it, then deleted.

8. General

Governing law: the law of Ukraine. Disputes go to the court at our place of registration. This does not remove a data subject's right to complain to the supervisory authority where they live.

We publish changes to these Terms at real-stat.net with 14 days' notice; continued use is acceptance. If any provision is unenforceable, the rest stands.
